1Definitions

Throughout these Terms, the following words carry the meanings given below:

• "Agreement" means these Terms and Conditions, together with our Privacy Policy and Cookie Policy, as updated from time to time.
• "Service" means the senior living residence arrangements, support services, outings and related activities offered by Fook Yuen, as described on this website.
• "We / Us / Our" means Fook Yuen Senior Living Residence, located at 116 Waterloo Road, Ho Man Tin, Kowloon, Hong Kong.
• "You / User" means any individual who visits this website or enquires about, or enters into a residence arrangement with, Fook Yuen.
• "Content" means all text, images, photographs, illustrations, layouts and other material published on this website.
• "Resident" means a person who has entered into a written residence arrangement with Fook Yuen.

2Acceptance of Terms

By accessing this website or submitting an enquiry, you agree to be bound by this Agreement. If you are making enquiries on behalf of another person — for example, an elderly family member — you confirm that you have their knowledge and, where appropriate, their authority to do so.

To enter into a residence arrangement with us, you (or the prospective Resident) must be at least 18 years of age and have the legal capacity to enter a binding agreement. Our residence services are designed for adults aged 60 and above; however, this does not affect the legal capacity requirement for the person entering the arrangement.

3Service Description

Fook Yuen is a non-medical senior living community. We provide:

• Daily Living Support — discreet household assistance including tidying, laundry, errands and gentle reminders, at HK$1,150 per month.
• Excursions and Day Outings — small-group outings to markets, parks, temples and the harbourfront with comfortable transport and an accompanying host, at HK$2,380 per month.
• Complete Residence Living — an all-inclusive monthly arrangement covering a private room, housekeeping, dining, outings and community activities, at HK$3,840 per month.

Our services are available to residents in Hong Kong. We do not provide medical, nursing, or clinical care. If a Resident requires medical attention, we will assist in arranging appropriate external support, but this falls outside the scope of our services.

Service availability, pricing and scope are subject to change. Any changes will be communicated to Residents with reasonable notice.

4User Responsibilities

Acceptable Use

When using this website, you agree to do so only for lawful purposes and in a manner that does not interfere with others' use of it.

Prohibited Activities

You must not:

• Use this website to transmit unsolicited communications or marketing material.
• Attempt to gain unauthorised access to any part of this website or its related systems.
• Use automated tools to scrape, copy or distribute Content from this website without prior written consent.
• Submit false or misleading information through any enquiry form.
• Use this website in any way that could damage our reputation or that of Fook Yuen's residents or staff.

Accurate Information

When submitting an enquiry or entering into a residence arrangement, you agree to provide accurate and complete information, and to notify us promptly if any information changes.

5Intellectual Property

All Content on this website — including text, imagery, design elements and the overall arrangement of pages — is owned by or licensed to Fook Yuen. It is protected under Hong Kong copyright law and applicable international agreements.

We grant you a limited, non-exclusive, non-transferable licence to view and print Content from this website solely for your personal, non-commercial use in connection with considering our services. No other use is permitted without our prior written consent.

The name "Fook Yuen", the Chinese characters 福苑, and any logos or marks used on this website are the property of Fook Yuen. You may not use them without prior written permission.

6Payment Terms

Monthly service fees are as listed on this website and in any written residence agreement. All fees are quoted in Hong Kong Dollars (HKD).

Payment is typically due on or before the first day of each calendar month. Specific payment methods and schedules will be agreed in writing at the time of entering a residence arrangement.

Changes to Fees

We may review monthly fees from time to time. Where a fee increase is proposed, we will provide at least 30 days' written notice to affected Residents before any change takes effect.

Discontinuation

If a Resident or their family wishes to discontinue a service, written notice must be given in accordance with the terms of the signed residence agreement. Fees paid in advance for an unused period will be considered on a case-by-case basis, taking into account the circumstances and any applicable provisions in the individual agreement.

7Residence Terms

Each residence arrangement is subject to a separate written agreement signed between Fook Yuen and the Resident (and/or their authorised representative). That agreement governs the specific scope of services, room allocation, meal arrangements and any other individual provisions.

These Terms and Conditions apply to use of this website and to the general relationship between you and Fook Yuen. In the event of any inconsistency between these Terms and a signed residence agreement, the signed residence agreement shall prevail with respect to the services it covers.

Health and Safety

Residents and their visitors are asked to observe the community's house guidelines, which are provided on arrival. These are in place to support the comfort and wellbeing of all residents.

8Disclaimers

This website and its Content are provided in good faith for general information purposes. While we take care to keep information accurate and up to date, we make no representation that it is complete, current, or free of errors.

We do not provide medical, clinical, legal, financial or professional advice through this website. Nothing on this website should be read as a substitute for advice from a qualified professional.

Our services are designed to support daily living and community participation for older adults. We do not represent that participation in any activity or programme will produce any particular health or wellbeing outcome for any individual.

9Limitation of Liability

To the fullest extent permitted by law in Hong Kong, Fook Yuen shall not be liable for any indirect, incidental, or consequential loss arising from use of this website or from any residence services provided, except where such liability cannot be excluded under applicable Hong Kong law (including the Control of Exemption Clauses Ordinance, Cap. 71).

Our total liability to you in respect of any claim arising out of or in connection with these Terms shall not exceed the total fees paid by you (or on your behalf) to Fook Yuen in the three months preceding the event giving rise to the claim.

We are not liable for any failure or delay in providing services where this arises from circumstances beyond our reasonable control, including but not limited to natural disasters, public health emergencies, government actions, or third-party failures.

10Indemnification

You agree to indemnify and hold harmless Fook Yuen, its staff and representatives from any claims, losses, costs or expenses (including reasonable legal fees) arising from your breach of this Agreement or your misuse of this website, to the extent permitted by Hong Kong law.

11Termination

We reserve the right to restrict access to this website at any time, for any reason, without notice.

Either party may terminate a residence arrangement in accordance with the terms of the applicable signed agreement. Termination of a residence arrangement does not affect any rights or obligations that arose before the termination date.

Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification) and 12 (Dispute Resolution) survive any termination of this Agreement.

12Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong in respect of any dispute arising out of or in connection with this Agreement.

13General Provisions

• Entire Agreement. These Terms, together with our Privacy Policy, Cookie Policy and any signed residence agreement, constitute the entire agreement between you and Fook Yuen regarding the subject matter herein.
• Severability. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force.
• Waiver. Our failure to enforce any provision of this Agreement shall not constitute a waiver of our right to enforce it in future.
• Assignment. You may not assign your rights or obligations under this Agreement without our prior written consent. We may assign our obligations to a successor in the event of a transfer of the business.
• Notices. Any formal notices under this Agreement should be sent in writing to 116 Waterloo Road, Ho Man Tin, Kowloon, Hong Kong, or by email to [email protected].

14Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or operational practices. When we do so, we will update the "Last Updated" date at the top of this page.

If the changes are material, we will endeavour to inform current Residents directly. Your continued use of this website after any update constitutes your acceptance of the revised Terms.

We recommend checking this page periodically if you visit us regularly.
